TYPE OF DATA COLLECTED; SOURCE OF DATA

The types of data we collect about you depend on your interactions with us and our Platform. In this section, we describe the categories of data we collect, organized by the sources of this data. By interacting with the Platform, you grant us the right to use your data to enable us to provide the Platform to you, to improve the Platform, and other uses as stated in this Privacy Notice, in our Terms of Use, and in any ancillary agreements you may have entered with us related to our Platform. If you do not provide your data when requested, you may not be able to use the Platform in whole or part if that data is necessary to provide the Platform in whole or part or if we are legally required to collect the requested data to provide the Platform in whole or part.

 

Data You Directly Provide to Us

We may collect the following types of data that you provide directly to us, such as by visiting or interacting with the Platform.

Personal Data. Data by which you may be personally identified such as name, email, phone number, physical address, profile photo, or any other data that could be associated with or used to identify you (“personal data”).

Demographic Data. Data that is about you but that as an individual piece of data does not specifically identify you.

Login Data. Data related to your account such as username and password.

Rental Data. Data related to your physical characteristics, including weight, height, and body measurements (such as estimated stride and shoe/foot measurements or apparel size).

Transaction Data. Data related to your order, such as the type of product requested or purchased including the size, gender (if applicable), purchase price, quantity purchased, UPC associated with the product, how it was purchased (i.e., via mail, phone, web, or in Store), catalog ID of the product, and details of the order, such as order date and delivery information.

Financial Data. To complete a product purchase transaction, you may be required to provide payment and financial data such as the type of payment card used to make the purchase and the payment card number, expiration date, security code, and billing address. When you provide such data, it is processed directly by a third-party payment processor. We do not process, transmit, handle, or store such data. However, through our third-party provider, we may be able to access such data.

Surveillance Footage. We use video-only surveillance in our Stores to detect and address security and safety incidents, shoplifting, other potentially illegal activities, and adequate staffing considerations. If you enter any of our Stores, your images may be collected for these purposes.

Communications Data. Data contained in your communications with us through our Platform, such as when you request additional information about our products or services, provide us with feedback, fill in forms on the Platform, or interact with our Customer Care Representatives, including your personal data used to contact you, the date and time of your communications, and the content of your communications.

Promotional Events Data. Data related to your participation in our events. For example, if you register for or attend an event that we host or sponsor, we may collect data related to your registration for and participation in such event. We may also capture images, videos, or other content to use for promotional purposes including posting on our social media accounts.

 

Data We Automatically Collect About You

As you navigate through and interact with our Site, we may use cookies, log files, pixel tags, software development kits (SDKs), and other client-side or server-side automatic data tracking technologies (“Automatic Tracking Technologies”) to collect certain data about your equipment, browsing actions, and patterns, including the following types of data.

Device information. We may collect certain data when you interact with the Site such as technical data about your device including your IP address; unique identifiers; unique device identifier and device type; domain, browser type, version, and language; operating system and system settings; general location information and time zone; and similar device and usage information.

Usage Data. We may collect data about details of your visits to and usage of our Platform including, usage details (i.e., date/time/duration on a given website page), traffic data, logs, general location based on your IP address, heat maps that show where your mouse is on a website page and other communication data and the resources that you access and use on the Platform. This data may include links clicked, website page views, purchases, searches, features used, items viewed, time spent within the Platform, or items you add to your cart.

Behavioral Tracking Data. Data about your online activities over time and across third-party digital assets or other online services.

 

The Automatic Tracking Technologies we may use include:

Cookies. (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate settings on your browser. However, if you select this setting, you may be unable to access certain parts of our Site. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Site.

Log Files. Log files are software-generated files containing data about the operations, activities, and usage patterns of an application, server, or IT system, such as what was done and a what time.

SDKs. A Software Development Kit or “SDK” represents a consolidated package of pre-existing code, enhancement tools, and guidance documents that can be installed and used to develop applications for particular platforms. SDKs allow our partners to directly extract data from our Site. The data collected has numerous applications including offering us insightful analytics about our Site’s usage, enabling social media incorporation, introducing new attributes or capabilities to our Site, or assisting in tracking and enhancing the efficacy of our online advertisements.

Flash Cookies. Certain features of our Site may use locally stored objects (or Flash cookies) to collect and store data about your preferences and navigation to, from, and on our Site. Flash cookies are not managed by the same browser settings as are used for browser cookies.

Web Beacons. Pages of our Site may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or for other related Site statistics (for example, recording the popularity of certain Site content and verifying system and server integrity).

 

Third-Party Use of Automatic Tracking Technologies

Some content or applications on the Site are served by third parties. These third parties may use Automatic Tracking Technologies to collect information about you when you use our Site. The information they collect may be associated with your personal data or they may collect information, including personal data, about your online activities over time and across different websites and other online services. Similarly, this Site uses Google Analytics, which uses cookies or other Automatic Tracking Technologies to help us analyze how users interact with and use the Site, compile reports on activity, and provide other services related to activity and usage. Data We Collect from Other Sources

We may receive data about from other sources such as service providers and third parties. The other sources we may receive data from include:

Service Providers. We may collect data from our service providers. These service providers are companies or individuals we engage with that perform services on our behalf to operate and maintain the Platform. These service providers are restricted to only use the personal data we provide to them as authorized under our contracts with them. As part of those services, our service providers may disclose data to us, including personal data.

Third Parties. We engage third parties to assist with business operations including operating and maintain the Platform, provide statistics and other analytics about the Platform, and marketing and enhancing our marketing efforts. These third parties may provide data to us. Those third parties may include:

  • Analytics Providers. Our analytics providers assist us with tracking, reporting, and analyzing statistics about our Platform.
  • Advertising Providers. Our advertising providers assist us with strategizing, creating, deploying, and analyzing our marketing and advertising efforts and the success thereof.

HOW WE USE YOUR DATA

Provide our Products or Services to You. Our Platform is designed to provide certain products and services to you such as high-end, luxury clothing, gifts, home furnishings, ski equipment, and demo-rentals. When you use our Platform, you provide us with access to the data described above in this Privacy Notice. We use your data to effectively deliver the Platform to you and to administer, present, support, maintain, improve, and fulfill your requests for our products or services available to you.

Improve our Platform. We may process your data to improve our Platform and deliver better and a more personalized Site, including by enabling us to: estimate our audience size and usage patterns; store data about your preferences or selections such as products in your cart; market or advertise our Platform to you; or recognize you when you return to our Site.

Complete Transactions.We may process your data to complete the transactions you request, perform our contractual obligations, including processing payments through third-party vendors, and as otherwise anticipated within the context of our ongoing business relationship.

We may process your data to detect and protect against malicious, deceptive, or illegal activity, including fraudulent transactions, error, negligence, breach of contract, security incidents, and harm to the rights, property, or safety of us and our users, customers, employees, or others.

Troubleshoot. We may process your data to debug, identify, and repair errors that impair the existing intended functionality of our Site.

Facilitate Corporate Transactions. We may process your data in anticipation of or in connection with a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Gorsuch’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by Gorsuch is among the assets transferred.

Obtain Your Consent. We may process your data in accordance with your consent when you intentionally direct or instruct us to do so, or any other way we may describe when you provide the data.

Comply with Legal Obligations. We may process your data to comply with our legal or regulatory obligations, including our tax obligations and those related to the prevention of fraud and money laundering, and those required for you to benefit from rights recognized by law, or any regulatory requirements or provisions.

In addition to the descriptions above regarding how we may use your data, we may also use your data as follows:

Aggregated, Anonymized, or De-identified Data. The data we collect via Automatic Tracking Technologies may include personal data. We may process it or associate it with data we collect in other ways or receive from third parties. We may use that aggregated data to enhance and personalize your experience with us, for promotional purposes, testing our IT systems, research, data analysis, improving our Platform, developing new products and features, and for other purposes described in this Privacy Notice.

Inferences from Your Data. In addition to the types of data and sources of data we describe above, we may also draw inferences or derive data about you based on other types of data we collect about you to create a profile reflecting your interests, preferences, and characteristics. We may use this data to enhance your experience on the Platform, to track analytics about the usage of our Platforms, or to serve advertisements, including targeted advertisements to you.

 

WHO WE SHARE YOUR DATA WITH & THE PURPOSE OF DISCLOSURE

We may disclose data that we collect from you or that you provide as described in this Privacy Notice to the following categories of third parties and for the purposes set forth below.

Advertising Providers; Analytics Providers; Data Providers. We engage others to provide analytics services, serve advertisements, and perform related services across the web and in mobile applications. These entities may use Automatic Tracking Technologies to collect data about your use of the Site, and other websites and applications, including your IP address and other identifiers, web browser network information, pages viewed, time spent on pages or in apps, links clicked, and conversion data. This data may be used to deliver ads targeted to your interests on other companies’ sites or mobile apps, analyze and track data, determine the popularity of certain content, and better understand your online activity. Our advertising partners then use that unique identifier to show ads that are more relevant to you across the web and in mobile apps.

Service Providers. We disclose data to unaffiliated companies or individuals we hire or work with that perform services on our behalf, including customer support, web hosting, software developers, information technology, payment processing, financing, marketing and database management, direct mail and email distribution. These service providers may have access to data we collect from you to perform services for us and are contractually obligated to only use it for the purposes in which we provide it.

Other Third Parties. We also disclose data to unaffiliated companies or individuals we hire or work with to perform services on our behalf including IT services, customer support, and database management.

Corporate Transaction. Your data may be disclosed or transferred in anticipation of or in connection with a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Gorsuch’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by Gorsuch is among the assets transferred.

Law Enforcement Authorities and Individuals Involved in Legal Proceedings. We disclose data when we believe doing so is reasonably necessary to comply with applicable law or legal process (including an enforceable request from authorities), to respond to claims (including inquiries by you in connection with your purchases from us), enforce or apply our other policies, or to protect the rights, property, or personal safety of us, our users, employees, or others.

Your Consent or at Your Direction. We disclose data, such as profile data and communications data, to third parties when we have your consent or direction to do so. We may also disclose your data to third parties, as when you expressly direct us to do so or when you use our products or services to intentionally interact with third parties. In these cases, we disclose your data to carry out your request.

Aggregated, Anonymized or De-identified Data. We may also disclose aggregated, anonymized, or de-identified data, which cannot reasonably be used to identify you, without restriction. We process this data only in a de-identified fashion and will n bot attempt to re-identify such data, except as permitted by law.

 

HOW WE PROTECT YOUR DATA

We have implemented measures designed to secure your data from accidental loss and unauthorized access, use, alteration, and disclosure.

The safety and security of your data also depend on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. Do not share your password with anyone.

Unfortunately, the transmission of data via the Internet is not completely secure. Although we use reasonable efforts to protect your data, we cannot guarantee the security of your data transmitted to our Platform. Any transmission of data is at your own risk. We are not responsible for the circumvention of any privacy settings or security measures contained in the Platform.

 

RETENTION OF YOUR DATA

We may retain your data for as long as we need it to provide you with the Platform. If you ask us to delete your data including your account, there may be some latency in deleting this data from our servers and back-up storage and some data may not be completely removed from our logs and other records. In addition, we may retain this data if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.

When we process personal data, we determine the retention period taking into account various criteria, such as the type of products or services provided to you, the nature and length of our relationship with you, the impact on our products or services we provide to you if we delete some data from or about you, and mandatory retention periods provided by law.

Automated Tracking Technologies and Targeted Advertising

If you disable or refuse Automated Tracking Technologies, please note that some parts of the Site may then be inaccessible or not function properly.

Targeted Advertising. We work with certain Analytics and Advertising Providers, as described in the Who We Share Your Data With & The Purpose of Disclosure section above and allow these Analytics and Advertising Providers through our Site to place Automatic Tracking Technologies on your browser or device to collect data about you. Some of our Analytics and Advertising Providers may be members of the Network Advertising Initiative (“NAI”) and/or are subject to the Self-Regulatory Principles for Online Behavioral Advertising published by the Digital Advertising Alliance (“DAA”). Some U.S. state privacy laws require us to provide residents additional privacy disclosures and inform them of their rights. 3. Data We Do Not Collect

We do not intentionally collect data on persons under the age of 18. We do not intentionally collect sensitive data. If we become aware of the collection of sensitive data or data on persons under the age of 18, we will delete it.

 

4. Data Retention

We may retain your data, including personal data for as long as we need it to provide you with the Platforms. If you delete your account, we’ll also delete this data. There might be some latency in deleting this data from our servers and back-up storage and some data may not be completely removed from our logs and other records. We may retain this data if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.

When we process personal data for our own purposes, we determine the retention period taking into account various criteria, such as the type of services provided to you, the nature and length of our relationship with you, possible re-enrollment with our Platforms, the impact on our Platforms we provide to you if we delete some data from or about you, and mandatory retention periods provided by law and the statute of limitations.

7. Your Rights and Choices

The U.S. State Privacy Laws may provide you with specific rights regarding your personal data. This section describes your rights and explains how to exercise those rights. Certain requirements must be met for consumers to exercise their rights, see Exercising Your Rights below for more information on what requirements must be met and how to exercise said rights.

Some of the activities may be considered “sales” or “sharing” of your personal data or “targeted advertising” under applicable U.S. State Privacy Laws. Depending on where you reside, you may have the right to opt out of targeted advertising, sharing, and sales of your personal data.

 

8. Opt-Out Rights

8.1 Sale/Sharing of Your Data

Our use of your personal data may be considered a sale/sharing under some U.S. State Privacy Laws. If you would like to opt out of the sale/sharing of your personal data you may email us at the email listed in the How to Contact Us section below.

8.2 Profiling

We do not use your personal data to profile in furtherance of decisions that produce legal or similarly significant effects.

 

9. Access Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal data, including:

  • The categories of personal data we collected about you.
  • The categories of sources for the personal data we collected about you.
  • Our business or commercial purpose for collecting or selling that personal data.
  • The categories of third parties with whom we share that personal data.
  • The specific pieces of personal data we collected about you in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hinderance (also called a data portability request).
  • If we sold or disclosed your personal data for a business purpose, two separate lists disclosing:
  • sales, identifying the personal data categories that each category of recipient purchased; and
  • disclosures for a business purpose, identifying the personal data categories that each category of recipient obtained.

10. Data Correction Rights

Under U.S. State Privacy Laws, you have the right to request that we correct inaccurate personal data that we collected from you and retained, taking into account the nature of the personal data and the purposes of processing personal data. Once we receive and confirm your consumer request (see Exercising Your Rights for more information), we will use commercially reasonable efforts to correct the inaccurate personal data (and where required by applicable U.S. State Privacy Law, direct our service providers to correct) your personal data from our records, unless an exception applies.

 

11. Deletion Rights

Under certain applicable laws, you have the right to request that we delete any of your personal data that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your consumer request (see Exercising Your Rights for more information), we will delete (and where required by applicable law, direct our service providers to delete) your personal data from our records, unless an exception applies.

These exceptions include retaining the information if it is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal data, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.


12. Exercising Your Rights

Only you, or someone legally authorized to act on your behalf, may make a “verifiable consumer request” (subsequently referred to as a “consumer request”) related to your personal data. You may also make a consumer request on behalf of your minor child. Please submit a consumer request to: calling us at the phone number listed below in the How to Contact Us Section.

To be verifiable, a consumer request must include:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal data or an authorized representative and that you have rights under this notice.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal data if we cannot verify your identity or authority to make the request and confirm the personal data relates to you.

Making a consumer request does not require you to create an account with us, but we may require authentication of the consumer that is reasonable in light of the nature of the personal data requested.

We will only use personal data provided in a consumer request to verify the requestor’s identity or authority to make the request.

 

13. Initial Request

We endeavor to respond to a consumer request within 45 days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.

If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal data that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your consumer request unless it is excessive or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.


14. Appeal Request

Under certain U.S. State Privacy Laws, you may have a right to appeal our decision regarding your initial consumer request.

If you have a right to appeal, your appeal should be sent to the place where the initial consumer request was sent (see Exercising Rights). The appeal should clearly indicate that it is an appeal of an initial consumer request and should include the initial request along with our response explaining why we cannot comply with the request.

If we require more time than the initial appeal timeline, and we are allowed to extend our response time under applicable U.S. State Privacy Laws, we will notify you within the original timeframe letting you know we require more time and reason for the delay.

If you have any concerns about the results of an appeal, you may have the right to be notified under U.S. State Privacy Laws that you can submit a complaint to your attorney general. 15. Non-Discrimination

We will not discriminate against you for exercising any of your rights under applicable law. Unless permitted by applicable law, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.


16. Other California Privacy Rights

California’s “Shine the Light” law (Civil Code § 1798.83) permits users of the Site who are California residents to request certain information regarding our disclosure of personal data to third parties for their direct marketing purposes.
